PERSONAL DATA PROCESSING POLICY

Malík Transport s.r.o., with its registered office at Jugoslávská 595/26, 613 00 Brno, Company ID No.: 290 18 498, registered in the Commercial Register maintained by the Regional Court in Brno under file No. C 93726, hereinafter referred to as the “Company”, approaches personal data with maximum responsibility, protects all processed personal data and processes it in accordance with generally binding legal regulations, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC, the General Data Protection Regulation, hereinafter referred to as “GDPR”, and Act No. 110/2019 Coll., on personal data processing.

The purpose of this policy is to inform customers, as well as other persons whose data may be processed by the Company, about how the Company processes and protects personal data, including information about the rights of data subjects and how to exercise them.

Personal data controller

Purpose of personal data processing

The Company processes personal data mainly for the purpose of entering into a contractual relationship, with the legal basis being the performance of a contract, i.e. the delivery of goods. In addition, the Company may process personal data to fulfil legal obligations, especially obligations under accounting and tax legislation, and for the establishment, exercise and defence of legal claims.

After the contractual relationship has ended, the Company may retain some of your personal data where such processing is necessary to protect the Company’s rights and for the possible defence of legal claims, including the recovery of unpaid amounts.

Personal data processed

For the purposes stated above, the Company processes personal data provided by you. This mainly includes the following data:

  • identification data such as first name, surname, title, date of birth, residence address, registered office, Company ID No., VAT ID No. and bank details;

  • contact details, including e-mail and telephone contact.

Processing of personal data based on consent

If you give the Company consent to process your personal data for the purpose of sending commercial communications or contacting you with product offers by e-mail or telephone, you acknowledge that providing this consent is voluntary and that it may be withdrawn in writing at any time. Consent is granted until it is withdrawn.

Cookies

When visiting the website, the Company may process your personal data through cookies. The purpose of this processing is to improve the user experience, create website traffic analyses, obtain additional information about how customers use the Company’s website and customise the website content.

The cookies used on the Company’s website are divided into categories according to whether and for what purpose they process personal data. In the cookie settings, you can find out more about each category and allow or refuse the use of all cookies, except necessary cookies, or selected categories of cookies. Once you disable a category, all services using cookies assigned to that category will be disabled.

Recipients of personal data

The Company makes personal data available only to authorised employees or individual processors of personal data from contracted companies, always only to the extent necessary to fulfil the individual purposes of processing and on the basis of an appropriate legal basis for personal data processing. In cases provided for by law, the Company is obliged to transfer certain personal data under applicable legal regulations, for example to law enforcement authorities or other public authorities.

Period of personal data processing

Personal data is processed and stored for the duration of the contractual relationship and subsequently for the period during which the Company, as the controller, is obliged to store personal data under generally binding legal regulations, or for the period for which you have granted consent to the Company. In other cases, the processing period depends on the purpose of processing, to which it must be proportionate, or is determined by personal data protection legislation.

Rights of the data subject

As a data subject, you have rights in connection with the processing of personal data that arise from legal regulations and that you may exercise.

You have the right to request information from the Company about the processing of your personal data.

You have the right to have the Company correct inaccurate personal data concerning you without undue delay. Taking into account the purposes of processing, you have the right to have incomplete personal data completed, including by providing a supplementary statement.

You have the right to have the Company erase personal data concerning you without undue delay, and the Company is obliged to erase personal data without undue delay if one of the grounds set out in the GDPR applies.

You have the right to have the Company restrict the processing of personal data in the cases set out in the GDPR.

You have the right to object to the processing of personal data concerning you if the Company processes personal data for the following reasons:

  • processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Company;

  • processing is necessary for the purposes of the legitimate interests of the Company or a third party;

  • for direct marketing purposes;

  • for scientific or historical research purposes or for statistical purposes.

You have the right to receive the personal data concerning you that you have provided to the Company in a structured, commonly used and machine-readable format, and the right to transmit this data to another controller without the Company preventing you from doing so, in the cases set out in the GDPR. This is the right to data portability.

If the processing of personal data is based on consent provided by you, you have the right to withdraw this consent at any time.

If you believe that legal regulations relating to the protection of your personal data have been violated, you have the right to lodge a complaint with the supervisory authority. The supervisory authority is the Office for Personal Data Protection, with its registered office at Pplk. Sochora 27, 170 00 Prague 7. www.uoou.cz.
